Terms of Service
These Terms of Service govern training, skills reviews, cohort participation, and related materials offered by Switchyard Learning Group LLC (“Switchyard,” “we,” or “us”). By requesting information, enrolling in a program, or using our site, you agree to these terms. If you enter on behalf of an employer, you confirm that you may bind that employer.
Services
Switchyard provides instructor-led and self-directed education in computer systems administration, network operations, systems reliability, defensive administration, and career practice. A program may include live sessions, lab exercises, written feedback, cohort discussion, and completion records. The current program description, enrollment confirmation, and any written statement of work form part of the agreement for a paid engagement.
Training is educational. It is not managed IT service, emergency response, legal advice, security monitoring, certification, employment placement, or a promise that a learner will receive a role, promotion, interview, or particular compensation. Labs use simulated environments. Do not rely on a lab exercise as a substitute for testing a change in your own organization.
Enrollment, fees, and cancellations
Fees, cohort dates, payment timing, and cancellation terms are shown in the applicable proposal or enrollment confirmation. Unless that document states otherwise, invoices are due within 15 days of issue in U.S. dollars. Late balances may pause access to sessions or materials after notice. A participant may request a transfer to a later cohort before the first live session, subject to seat availability. We may cancel or reschedule a cohort when enrollment, instructor availability, weather, or events beyond our reasonable control make delivery impractical; in that case, we will offer a comparable future session or refund the unused portion paid to us.
Learner responsibilities
You are responsible for accurate enrollment details, a suitable workstation and internet connection, and safeguarding your own account or invitation links. Use the training respectfully. Do not disrupt sessions, probe systems outside the assigned scope, introduce malicious code, attempt to bypass lab controls, share another participant’s personal information, or present simulated work as a production credential. Bring questions, not workplace secrets. Real credentials, customer data, and regulated records do not belong in class chat, submitted notes, or lab systems.
We may remove a participant from a session for conduct that threatens people, systems, or the learning environment. Where removal is caused by a material breach of these terms, fees are not refundable. No drama. Just basic operating discipline.
Materials and intellectual property
Switchyard and its licensors retain rights in course structures, scenarios, presentations, exercises, marks, and site content. Subject to payment and these terms, an enrolled learner receives a limited, nontransferable right to use materials for personal or internal business learning. You may keep your own notes and work product, provided it does not reproduce substantial portions of our materials or expose other participants’ information. You may not sell, republish, publicly display, or use course materials to train competing services without our written permission.
You retain rights in content you submit, but grant us permission to use it as needed to provide feedback and administer the program. Do not submit content you lack the right to share.
Availability and changes
We aim to present accurate schedules and program information. Mistakes happen. We may correct typographical errors, revise a syllabus, substitute an instructor with comparable experience, or change a lab scenario when doing so preserves the learning objective. We will not materially reduce a paid program without offering a reasonable remedy. Site features and optional resources may change without notice.
Disclaimers and limitation of liability
To the extent permitted by law, services and materials are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that training will be uninterrupted, error-free, suitable for every environment, or accepted by any employer.
To the extent permitted by law, Switchyard’s total liability arising from a program will not exceed the fees paid to us for that program in the six months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for loss of data, business interruption, or decisions made in a learner’s production environment. Some jurisdictions restrict these limitations, so parts may not apply to you.
Termination and privacy
Either party may end an ongoing engagement as provided in its written agreement. We may end or suspend access for nonpayment, misuse, security concerns, or material breach. Provisions concerning fees, intellectual property, confidentiality, disclaimers, liability limits, and dispute resolution survive termination. Our handling of personal information is described in the Privacy Policy.
Law and disputes
North Carolina law governs these terms, without regard to conflict-of-law rules. Before filing a claim, each party will give written notice and try in good faith to resolve the issue for 30 days. If no resolution is reached, exclusive venue lies in the state or federal courts located in Durham County, North Carolina, except that either party may seek equitable relief for intellectual property misuse or misuse of systems.
